| यह अनुबंध अगम सेवा फाउंडेशन (संस्था) और सेवा प्राप्तकर्ता इकाई (कंपनी) के बीच 'सक्षम भारत योजना' के सफल क्रियान्वयन हेतु कानूनी रूप से बाध्यकारी है। कंपनी द्वारा उम्मीदवारों की स्वीकृति इस अनुबंध की सभी शर्तों की सहमति मानी जाएगी। | This agreement is legally binding between Agam Seva Foundation (Organization) and the Service Recipient Entity (Company) for the implementation of 'Saksham Bharat Yojana'. Acceptance of candidates by the company implies consent to all terms. |
| 2. कैंडिडेट सुरक्षा एवं वित्तीय अखंडता | 2. Candidate Safety and Financial Integrity |

लॉक-इन अवधि: कंपनी किसी भी कैंडिडेट को जॉइनिंग के प्रथम 30 दिनों के भीतर
सेवामुक्त नहीं करेगी। यह समय उम्मीदवार की कार्यक्षमता जांचने के लिए न्यूनतम वैधानिक सीमा
है। जीरो डिडक्शन पॉलिसी: यदि किसी अनिवार्य कारण से कंपनी कैंडिडेट को हटाती है, तो संस्था के सेवा शुल्क (Service Charge) में कोई भी कटौती नहीं की जाएगी। संस्था की देयता केवल उम्मीदवार के चयन तक सीमित है। |
Lock-in Period: The company shall not terminate any candidate within the first 30
days of joining. This is the minimum legal limit for assessing the candidate's
performance. Zero Deduction Policy: If the company removes a candidate for any mandatory reason, no deduction shall be made from the organization's Service Charge. Liability is limited to selection only. |
| 3. विधिक सुरक्षा एवं उत्तरदायित्व | 3. Legal Indemnity and Liability |
| विशेष नियम: कैंडिडेट के कार्यस्थल पर होने वाली किसी भी प्रकार की अप्रिय घटना, दुर्घटना, शारीरिक चोट या कानूनी विवाद की स्थिति में संस्था (अगम सेवा फाउंडेशन) किसी भी रूप में उत्तरदायी नहीं होगी। कार्यस्थल सुरक्षा, बीमा (ESI/PF) और श्रम कानूनों के पालन का संपूर्ण उत्तरदायित्व केवल कंपनी का होगा। | Special Rule: In case of any untoward incident, accident, injury, or legal dispute at the workplace, the Organization (Agam Seva Foundation) shall not be liable in any way. Responsibility for safety, insurance, and labor laws rests solely with the Company. |
| क्षतिपूर्ति: यदि कंपनी की किसी लापरवाही से कैंडिडेट को नुकसान होता है, तो कंपनी संस्था को किसी भी कानूनी मुकदमेबाजी से मुक्त (Hold Harmless) रखने के लिए बाध्य है। | Indemnification: If damage is caused due to company negligence, the company is bound to hold the organization harmless from any legal litigation. |
| 4. अनुबंध समाप्ति (नोटिस अवधि) | 4. Termination of Agreement |
| अनुबंध को समाप्त करने हेतु किसी भी पक्ष द्वारा दूसरे पक्ष को कम से कम 45 दिनों का लिखित नोटिस (Official Notice) देना अनिवार्य होगा। नोटिस अवधि के दौरान पुरानी शर्तें और भुगतान दायित्व यथावत रहेंगे। | To terminate the agreement, it is mandatory to give at least 45 days' written official notice. Existing terms and payment obligations remain intact during the notice period. |
| 5. संस्था एवं कंपनी के कर्तव्य | 5. Duties of Organization and Company |

• संस्था: उम्मीदवारों की योग्यता की प्राथमिक जांच और साक्षात्कार समन्वय के लिए जिम्मेदार है। • कंपनी: कैंडिडेट के कार्य आचरण, अनुशासन और कार्यस्थल पर उनके व्यवहार की निगरानी के लिए जिम्मेदार है। • गोपनीयता: कंपनी संस्था के डेटा को व्यावसायिक गुप्त रखेगी। |
• Organization: Responsible for primary screening and interview coordination. • Company: Responsible for monitoring conduct, discipline, and behavior at the workplace. • Confidentiality: The company shall keep the organization's data strictly confidential. |

MEMORANDUM OF UNDERSTANDING (MoU)
This Memorandum of Understanding (MoU) is executed on this day 06/06/2026 between the following two parties:

1. Objective
The primary objective of this MoU is to provide employment opportunities to trained and skilled youth under the "Saksham Bharat Yojana" by the First Party as per the requirements of the Second Party.
2. Financial Terms
The Second Party, after the joining of each selected candidate, shall provide a service fee of to the Foundation as professional charges.
